THE INFAMOUS "MINIMUM PURCHASE"
Have you ever had your credit card at the ready for an $8
purchase, only to be told that there's a $15 minimum? Well
the truth of it is, minimum purchase restrictions are WRONG!
Simply put, a merchant cannot impose a minimum purchase
limit. The merchant must accept your credit card regardless
of the amount of your purchase!
This is not governed by state or federal law, but, by the
credit card merchant's agreement. Every merchant who has a
merchant's credit card account will have signed a
"merchant's agreement" with the bank. This agreement, or
contract, simply states:
"HONORING CARDS. Merchant agrees to sell or lease
goods and services to the holders of all valid,
unexpired and properly tendered Cards. . .
MERCHANT SURCHARGE/MINIMUM. Merchant agrees not to
impose a surcharge on a Cardholder who elects to use
a [MasterCard or VISA] Card in lieu of payment by
cash, check or similar means. Merchant agrees not to
establish a minimum purchase price for a Card
Transaction."
In essence, this means that if a consumer wants to buy a
pack of gum and charge it, the merchant must accept the
card. This is provided of course the consumer's card is in
good standing and the consumer is the valid cardholder.
Here, if a merchant fails to honor the card and the consumer
complains, the bank could revoke the merchant's credit card
account.
